CAN-SPAM Act
Before we jump into the anti-spam regulations - please make sure to familiarize yourself with our article on The General Data Protection Regulations to be sure you are protecting your customers' personal data as well.
The Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003, also known as the CAN-SPAM Act, was signed to protect email receivers from unsolicited emails from brands and businesses.
The Act doesn’t apply just to bulk email. It covers all commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,” including email that promotes content on commercial websites. The law makes no exception for business-to-business emails.
All the emails you send with Tidio mailing tool must comply with the U.S. CAN-SPAM Act, even if your business is registered outside the United States. Below, you can see how to make sure you're meeting the Can-Spam act requirements.
CAN-SPAM’s main requirements
Here, you will find a few of the most important CAN-SPAM provisions that we kindly ask you to follow.
Don’t use false or misleading header information
The originating domain name and email address must be accurate and clearly identify the person or business. To set your operator's name go to the Settings > Account > Details section. However, to change your URL address head over to the Settings > Account > Preferences sections in your Tidio admin panel.
Don’t use deceptive subject lines
Your subject line must accurately reflect the content of the message.
Identify the message as an ad
You must clearly disclose that your message is an advertisement if you're sending some promotional emails.
Tell your recipients where you’re located
Your message must include your valid physical address. Please make sure that your address is correctly set up in the Settings > Campaigns > Address section in your Tidio panel.
Allow your recipients to opt-out of receiving future emails from you
All the emails sent from Tidio will have an unsubscribe button or link included in the footer to allow the recipients to stop receiving emails from you.
Respect opt-out requests
After your subscribers have resigned from receiving further correspondence from you, you are not allowed to sell or transfer their email addresses elsewhere, even in the form of a mailing list. The only exception is that you may transfer their details to a company you have hired to help you comply with the CAN-SPAM Act.
Monitor what others are doing on your behalf
Even if some other company is handling your email marketing, you are still subject to legal responsibility and expected to comply with the anti-spam law.
